Harvey Specter and Mike Ross

Know When to Fold 'Em is the fifteenth episode of the third season of Suits and the 43rd overall. It first aired on April 3, 2014.

Synopsis

Harvey faces off with a relentless attorney who goes after one of his biggest clients, Mike has to make a big decision, and former name partner Charles Van Dyke has an ax to grind.

  • James Quelling tries to extort Harvey Specter by fabricating a false claim that would tank his client's shares during an I.P.O. unless he is paid $1,000,000. However, when Harvey mentions Hessington Oil as an example of how he would not be staggered, Quelling discovers the settlement between Mike Ross and Harold Gunderson, which would be revealed to be a bribe. Quelling increases his settlement to two million dollars, threatening to report Harvey and Mike to the New York State Bar.
  • Mike is in turmoil over keeping his position as a junior associate or accepting his position as a partner at Sidwell Investment Group, not sure whether to continue being a lawyer or become an investment banker. After speaking with Rachel Zane and realizing that he cannot live with his secret hanging above his head, Mike announces that he is accepting Sidwell's offer. Harvey suggests that he have Lola Jensen hack his name into the Bar to prevent his secret from being ousted, although Mike informs Harvey that he is leaving.
    • Mike goes to Lola Jensen and has her hack into Quelling's private files, discovering that Quelling was being financed by Harvey's client's competitors, which is a violation. Mike threatens to report Quelling to the Bar, thus getting him disbarred, if he reports Mike first, adding that he doesn't mind getting disbarred in the process since it is his last day as a lawyer. Quelling, upon seeing the truth behind Mike's statement, decides to drop the case.
    • Harvey and Scottie have relationship hurdles as he is unable to answer any of her questions as it revolves around Mike. He then decides to tell her about Mike's fraud, an idea which Donna Paulsen shuts down. Mike then asks her for a minute and informs Harvey that he had Lola hack his name into the Bar's database and that he wishes to continue working as a lawyer.
  • Charles Van Dyke, of Gordon Schmidt Van Dyke, returns in order to gain an increase on his dividend check, which Jessica Pearson refuses. Jessica looks for Louis Litt to handle it, although Louis is at home, wallowing in depression. He asks Katrina Bennett to cover for him, and she does so by working with Rachel and finding a way to prevent Van Dyke from accessing their books. Katrina and Rachel come up with a solution – since Van Dyke's agreement is with Pearson Hardman, which doesn't exist anymore, it can therefore be annulled. They present this to Jessica, who takes it up against Van Dyke, only for him to notify Jessica that his agreement, in accordance with the by-laws, states that his dividend is dependent on the firm that has Jessica Pearson listed as a name partner.
    • Humiliated and embarrassed, Jessica fires Katrina and goes to Louis' house, where he tells her that the solution would be for Pearson Specter to become an LLC.
    • Van Dyke realizes that Daniel Hardman showed her the list he made, which reveals that he hired Jessica for the sole reason being that she was black and female, for pure diversity purposes, as opposed to her qualifications. Jessica admits that her feelings of disgust after the revelation is what pushed her to her current success.
